SMS Terms and Conditions
BY SIGNING UP FOR OUR TEXT (SMS) NOTIFICATIONS AND COMMUNICATIONS (“SMS SERVICES”), YOU AGREE THAT YOU HAVE READ AND UNDERSTOOD, AND, AS A CONDITION OF YOUR USE OF OUR SMS SERVICES, YOU AGREE TO BE BOUND BY THE FOLLOWING SMS TERMS AND CONDITIONS (“SMS TERMS”), INCLUDING OUR PRIVACY POLICY.
TAR Roofing Inc. may send you text (SMS) messages at the phone number you provide us. Your use of the SMS Service constitutes your agreement to these SMS Terms. We may modify or cancel the SMS Service or any of its features without notice. We may also modify these SMS Terms at any time, and your continued use of the SMS Service following the effective date of any such changes shall constitute your acceptance of such changes.
We do not charge for the SMS Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message and data rates may apply.
If you have opted in, the SMS Service provides a means for communicating with your salesperson or our customer service department. Message frequency is variable depending on the status of your projects.
You may opt out of receiving marketing text messages at any time by replying “STOP” from the mobile device receiving the messages or by sending an email to info@tarroofing.com indicating that you no longer wish to receive marketing texts along with the phone number of the mobile device receiving the texts or. In addition, you may text “STOP” to opt out at any time. You may continue to receive text messages for a short period while we process your request, and you will also receive a one-time text message confirming receipt of your request. For SMS Service support or assistance, reply “HELP” or email info@tarroofing.com.
We may change any short code or telephone number we use to operate the SMS Service at any time. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received. We will not be responsible for honoring requests made in such messages.
The wireless carriers supported by the SMS Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you change your mobile phone number, you agree to opt out of the SMS Service prior to changing your mobile number. You agree to indemnify, defend, and hold us harmless from any third-party claims, liability, damages, or costs arising from your use of the SMS Service or from you providing us with a phone number that is not your own.
You agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the SMS Service, any errors in such information, and any action you may or may not take in reliance on the information or SMS Service.
SMS Privacy Policy
TAR Roofing, Inc. is committed to protecting your privacy. This Privacy Policy (the “Policy”) governs how we treat the Personal Information that we collect and receive from you in connection with your use of the SMS Service (“Service”), which we make available to you through a third-party service provider. This Policy is incorporated into the Terms of Service.
By using the Service, you agree to the terms of this Policy. TAR Roofing, Inc. reserves the right, in its sole discretion, to modify or change this Policy at any time with or without prior notice to you.
“Personal Information” is information that individually identifies you, such as your mobile phone number or user/screen name, as well as any Personal Information that you choose to include in messages you send through the Service.
What Personal Information is collected about you
Through the use of the Service, TAR Roofing, Inc. will receive the following information from our third party service provider: your mobile phone number when you send a text message to us, the text of messages that you send to other users of the Service, any user or screen name that you select in connection with the Service, as well as any comments or feedback regarding the Service that you send to us.
How TAR Roofing, Inc. uses Personal Information about you
We use Personal Information to (a) provide you with the Service, (b) process and respond to inquiries, (c) improve the Service, and (d) if necessary, contact you with important announcements or messages.
Disclosure of your information
We will not rent or sell your Personal Information to other companies or individuals. We may use or disclose such information in any of the following limited circumstances:
- We have your consent.
- We need to enforce our Terms of Service.
- We provide such information to trusted businesses or persons for the sole purpose of processing Personal Information on our behalf. When this is done, it is subject to agreements that oblige those parties to process such information only on our instructions and in compliance with this Policy and appropriate confidentiality and security measures. If the third party fails to comply with our terms, TAR Roofing, Inc. is not accountable in any way for any liability or reimbursement.

- We provide such information to a company controlled by, or under common control with, TAR Roofing, Inc. for any purpose permitted by this Policy.

- We believe it is necessary to share Personal Information to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of TAR Roofing, Inc.’s Terms of Service, or as otherwise required by law.
- We transfer Personal Information about you if TAR Roofing, Inc. is, or its assets are, acquired by or merged with another company.
- We may share aggregated information with others without further notice. An example of this would be the number of people who used the Service in a given month or the total number of texts sent in a given week.
Security
TAR Roofing, Inc. takes precautions to ensure the security of your Personal Information, including ensuring that our third party service providers protect the security of your Personal Information. However, we cannot guarantee that hackers or unauthorized personnel will not gain access to your Personal Information despite our efforts. You should note that in using the Service, your information will travel through third party infrastructures which are not under our control (such as a third party SMS delivery platform or your carrier network).
We cannot protect, nor does this Policy apply to, any information that you transmit to other users. You should never transmit personal or identifying information to other users.
Opting out
TAR Roofing, Inc.’s third-party service provider gives you the ability to opt out of the Service for any reason. You can opt out by texting “STOP” or “QUIT” to any SMS communication.
We reserve the right to send you certain communications relating to the Service, such as announcements and administrative messages, without offering you the opportunity to opt-out of receiving them.
